Massachusetts Paid Family & Medical Leave Notice Requirements

Employers with one or more employees working in the state of Massachusetts are required to provide a written notice of the PFML benefits, contribution rates and other provisions on or before May 31, 2019.

What are the notice requirements?

The written notice may be provided electronically or in paper form to current employees and must include an opportunity for the employee to acknowledge receipt or decline to acknowledge receipt of the information.  The acknowledgement can be received in paper form, or electronically.

New employees must receive this notice within the first 30 days of their first day of employment.  Employers must also obtain a written acknowledgment or refusal to acknowledge the notice from new employees.

The notice must be written in the employee’s primary language.  Final version in English and translated versions of the template notice are available on the Massachusetts PFML website.  Employers may choose to create their own notice as long as it contains the same information in the template notice.

This written notice is in addition to the mandatory workplace poster which was released earlier.  The poster must also be made available in English and each language which is the primary language of five or more individuals.  Translated versions are available on the MA PFML website.  The poster must be posted in an easily accessible location.
