How to Navigate the New Vaccine Mandate Litigation

On September 9, 2021, President Biden announced major changes to US regulations for COVID-19 vaccinations, including new Emergency Temporary Standards (ETS) from OSHA that will require all employers with 100 or more employees to ensure their workforce is fully vaccinated or require any workers who remain unvaccinated to produce a negative test result on at least a weekly basis before coming to work.
While there's still a lot we don’t know about the ETS, we do know that it will be challenged in court, states will attempt to circumvent it, and that there are steps that organizations can take right now to get ready for the new vaccine rules.

Office Hours: The San Francisco Health Care Security Ordinance (HCSO)

The San Francisco Health Care Security Ordinance (HCSO) imposes an employer minimum health care expenditure requirement for certain employees working in San Francisco. Employers should be aware that merely offering a very generous (even free!) health plan will not satisfy the expenditure requirement for employees not enrolled in the plan if no exemption applies. Where the employer is not satisfying the expenditure requirement through the health plan, and no exemption applies, the employer needs to make quarterly contributions to the City Option that will in most cases fund an MRA on the employees’ behalf.
